This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Read the report that I prepared back in 2007 here. Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their upcoming changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities can't plan. I've heard of courses being cut because the government has no process in place for universities to send the newly required acceptance letters to the government.

This means that students who have been accepted can not attend courses that start in the summer 2024 semester. With cut sections, current Canadian students will have trouble getting courses, and may have to switch to part-time which changes their enrollment status and might trigger repayment of their loans or ineligibility for funding. I've seen this before. It wreaks havoc on the student loan borrowers.

Again, the Liberal government has messed up the education environment. Will the new system needed in a rush for the acceptance letters be the new Arrivecan scandal?

I call on the government to implement a slower phased in approach and delay the requirement of the acceptance letters until a process is in place to submit these letters.

    Posted: 04/June/2012 at 2:16pm
I just received a letter from CRA today saying that on behalf of HRSDC they are to collect $4000 for an unpaid student loan.  They go on to say I have 10 days from the date on the letter to make payment or they will either instigate legal action or another form of collection.
The problems with this letter are:
1. They mailed it to me May 4, and it arrived a month later, so the 10 day limit they imposed is way over.
2. I no longer live in Canada
3. When I did live in Canada, I renegotiated a mortgage with my ex-spouse and ALL our debts were supposedly paid off including my student loan, but I have no proof since the lawyer dealt with my ex, and when I left the abusive relationship I also had to leave most of my personal items behind, including documents.  (ps. my ex declared bankruptcy in 2009 and the house was repossessed, and most of my possessions went to landfill, as well as a lot of documents, all without my knowledge.)
4. If for some reason my debt wasn't paid by the lawyer, I have no way to pay it back, as I am living in another country now, awaiting residency, still no work permit after 2 years of waiting for one. I've been unemployed since 2009, and have a 12 month old baby.  In this country I live in now, it is also highly unlikely that I will get employment.  My husband only makes the equivalent of $1800/mth Canadian, and is supporting me, our child, and his 3 children from his previous marriage, so there is no way he can afford to pay this debt.
5. The HRSDC loan was taken out in 2004 and I started to pay it in Feb 2005. If I in fact still owe them, wouldn't the 7 year statute be started already, or is it from when the first payment has defaulted?

Sorry for all the questions, but I'm overwhelmed right now, and not being in Canada makes it even harder, so any help is appreciated. I intend to call them, but I want some guidance first on what actions they can take against a non-resident of Canada.

What role did your ex's lawyer play in the handling and payment of your loan?

Our mortgage was refinanced, and the lawyer for this company rolled in all our debts into this mortgage (car, credit cards, loans including my student loan). From what I understand, our previous mortgage company was paid off, and the 'extra' amount of our mortgage went to all our debts.  This lawyer paid them all on our behalf.  I'm so frustrated because I don't remember the name of the firm, and I am not going to ask my abusive ex-spouse (I have cut all ties with him for obvious reasons).
I'm just concerned that this loan may have been overlooked by this lawyer, and if so, it hasn't been paid for a few years.  If this truly is the case, I know that $4000 isn't much to owe, but at the moment I am unemployed with no income. I can't even offer to make any form of minimal payment and since I am no longer residing in Canada, I don't qualify for any form of relief as far as I know.  If I had the money, I wouldn't hesitate to pay if I truly owed them.
It's so frustrating, if I knew about this mess before I left Canada, I would have been able to deal with it so much easier.

Can you remember the lawyer's office address then google? Perhaps the name will jump out at you? Or contact one of the lenders, or the mortgage holder, as they might have the lawyer's name....
