This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their upcoming changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities can't plan. I've heard of courses being cut because the government has no process in place for universities to send the newly required acceptance letters to the government.

This means that students who have been accepted can not attend courses that start in the summer 2024 semester. With cut sections, current Canadian students will have trouble getting courses, and may have to switch to part-time which changes their enrollment status and might trigger repayment of their loans or ineligibility for funding. I've seen this before. It wreaks havoc on the student loan borrowers.

Again, the Liberal government has messed up the education environment. Will the new system needed in a rush for the acceptance letters be the new Arrivecan scandal?

I call on the government to implement a slower phased in approach and delay the requirement of the acceptance letters until a process is in place to submit these letters.

Hello,

I would like to say that this website is great.  I have been reading for months and now I have signed up.  What a great resource.

I have a question regarding RAP:

My wife is paying a student loan that she attained before we were married (around 2004).  She is not working right now and is on EI until Jan 2013.  Once EI runs out we don't know what to do.  She is having problems finding work.  Right now her EI allows her to pay her student loan payment, bills, share of the rent, and her food, but she is breaking even doing this.  If she cannot find work I will pay for her food, rent and cell phone, but I would rather she take care of her student loan payments on her own.

My questions is will the RAP program hold me responsible for paying her debt?  I notice on the application that it asks gross family income.  How do I maintain my privacy?  I am not legally tied to this debt.  I just want her to take advantage of the government programs that are available to her and not have it effect me at all.

Yep, they base it on family income, so the family is being held responsible for the debt.... it doesnt say so anywhere in the legislation and they wont come after you, but they will deny your spouse RAP, based on famliy income.  Is it fair, no.... what we need is for someone to file a privacy complaint or some other challenge.

Both bankruptcy and Canada student Loan law calls for transparency of total household income. People who enter into repayment for student loans are measured on what they spouses/partner's income is, which in my opinion is wrong. People who opt to file insolvency proceedings are also measured on what their spouse's/partner's income is. In my opinion that is wrong.  
 
If a spouse of a student loan borrower or potential bankrupt does not want to disclose his or her information to a another person or organization (government or not) then they do not have to. 
 
And because a spouse or partner of a student loan borrower or potential bankrupt has no legal obligation to pay debt that pertains to the student loans program or the bankruptcy, the borrower or bankrupt should not be penalized or treated unfairly because of that.
 
A student loan borrower is responsible to pay his or her student loan. So therefore, unless there is an endorsement or a signed co-borrower agreement on either the student loan or the debt being presented in a bankruptcy, then the loan or insolvency should, in my opinion, apply to only the party who is legally responsible for that debt.
 
The problem in Canada is that there are WAY TOO MANY laws that are over-lapped and completely ignorant of other laws, particualarly those that fall within the arena of human rights.
 
In my opinion, the manner in which the student loan system operates in Canada may be violating  individual's human rights by even asking (or demanding) that someone who is not legally responsible for the debt(s) to disclose their personal financial information so as to prejudice the position of a student loan borrower or bankrupt and deprive them of rights that they would otherwise be entitled to.
 
This is my quick two cents, and perhaps that is all it's worth. LOL

Absolutely agree.  These rules may actually prevent couples from getting married in the first place.

I really wish someone would file a complaint with the privacy commissioner...  even just using Johnny's wording...  It would help others out so much

People are afraid to get married because of student debt and the burden it imposes on them, and their personal relationships. The social impact is equally as devastating to people as the financial burden. The health implications are enormous and the system only increases the risk rather than attempt to reduce it.
