Some states have that ruling. Canada has different laws than the USA though. Some collection agencies usually have a recorded disclaimer in their automated message when you call the number. It may say "Your call may be recorded for quality assurance purposes', or "please note that your call will be recorded to ensure that ...". So, if you hang up, you do not agree to it. If you stay on the line and continue, then you are agreeing to it. If you argue, they can argue back.

Hi Johnny
I'm at a point where I want to settle (for a lessor amt) and pay up my loan through Nordon (dealing with the Rahman guy).
I want to:
1) make sure thats its settled once an for all and that they dont actually take the lumpsum (as interest) and then demand more later.
2) Clear up my credit rating with Equifax.
How do I do this and how do I deal with this Mr. Rahman/Raymond at Nordon? Im not too familar with this website.

Hi all, It has been over 2 mth since I've seen a post to this particular forum. I've only recently started looking online for help and advise.
Q: Nordon has sent me an "Evaluation of Debtor's Financial Status" to fill out to prove my ability to pay the amount I'm sending. It asks me to detail my whole financial life - SIN #, employer name & contact info, assets, bank accounts, make, model, value of car, mortgage payment, etc Is this a legit form? It has the provincial symbol and all, but that's available over the internet and even I am able to fake a form that looks better than this one. On consulting the BBB, they warn of Nordon's known use of shady practices, abusive agents and borderline illegal harrassment. My local BBB office advises NOT to fill out this form as it violates the Cdn. Privacy Act.
Advise?

Further to my previous post: Ms. Gage (who I deal with) has advised that I should try Wells Fargo for a loan to clear this up and obtain a "lower" interest rate than Nordon. I am to NOT send any more payments until I have explored this avenue. On being declined, I informed Ms. Gage who conveniently does not recall advising not to send payements and that nothing has been noted on my file. Do I/ Should I start recording all our convesations now?

First of all, Nordon is a collection agency. Not a lender. Only their client (your loan provider) charges interest. I assure you that the interest rate youa re paying associated with your student loan is much lower than any interest rate wells Fargo would write.
Wells Fargo is a high interest lending institution. High interest fnancial adventures are VERY dangerous.

No worries, Wells Fargo shot me down.
It makes me question why would she suggest such a dangerous move for me.
Is this "Eval of Debtor's Financial Status" a legit form in Ontario?
Friends say it resembles a welfare app. or the Interest Relief app. Can I post a scan of this form in .pdf for the forum's review?

I'm not sure if I'm in the right forum or what but I need some help.
Going back into the early to mid 90's I made a foolish decision to got back to school. Actually, it was the school that I chose which was the error. To make a long story shorter, I went to Devry Institute for a business ops. course that had something like a 2 to 2 1/2 year completion. After completing like 85% of my course I was forced to drop out because the funding from the government was suspended pending some issue Devry (Scarborough) campus had violated or whatever. Forgive my slight cloudiness on the issue due to it being 15 years ago. Anyway, I was unable to continue my studies because although the school would waive the remaining tuition fees until the matter was resolves,I was fully reliant on the monies I received from the CSL & OSL to pay for rent,bus fare, food etc... So, without this funding at that time I had to increase my hours at my part-time job to be able to survive thus, having to leave school.
I subsequently couldn't afford to pay back the the loans (tuition was $9,900/per year by the way). So, I would make sporadic payments when I could, bounced numerous cheques...my loans went into default and to this day 15years later I still owe my loans,obviously, but the current interest not to mention the accrued interest to this date has put me in a situation where my interest per month,strictly on my CSL has exceeded what I can afford to pay in a month. That is just for my CSL. As far my OSL goes, I had a yelling match over what I could and could not afford to pay and it escalted to such a point whereby the agent actually hung up the phone on me!!! I haven't called them in almost a year or more and just recently I have been receiving messages to return their calls. As far as the CSL goes, I'd like to make things right but I'm at a loss of what to do?
My original principal was something like $15K and now it is something like 19,900 and climbing fast. I've thought about returning the calls I continue to get but I know that an offering of less than or right at the amount of interest per month would be futile. I would never get rid of this albatross...Not to mention I never got my education either. I've been told after they're numerous attempts of trying to contact me that they will have to commence legal proceedings. I'm just afraid of calling and telling them that this is all I can afford ,if that, and having to argue about it and then them telling me that they will seek legal action anyhow...what do I do??? any suggetsions??
