This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Read the report that I prepared back in 2007 here. Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their upcoming changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities can't plan. I've heard of courses being cut because the government has no process in place for universities to send the newly required acceptance letters to the government.

This means that students who have been accepted can not attend courses that start in the summer 2024 semester. With cut sections, current Canadian students will have trouble getting courses, and may have to switch to part-time which changes their enrollment status and might trigger repayment of their loans or ineligibility for funding. I've seen this before. It wreaks havoc on the student loan borrowers.

Again, the Liberal government has messed up the education environment. Will the new system needed in a rush for the acceptance letters be the new Arrivecan scandal?

I call on the government to implement a slower phased in approach and delay the requirement of the acceptance letters until a process is in place to submit these letters.

    Posted: 16/March/2005 at 3:24pm

Today I got a phone message saying to return a call it was "of an urgent legal matter".  I called NCN and spoke with Pauline.  She advised me that if I don't come up with $3400 by today at midnight she was freezing my bank account.  The problem with this is initilly I was paying CBCL monthly payments, after about a year, CBCL returned 3 of my post dated cheques with a letter stating that I had not repaid my loan within a specified period of time, it was being returned to the Royal Bank.  I contacted a 1-800 # numerous times requesting information on where to continue paying.  never hear back until today...from NCN.  I offered to pay it out in large amounts weekly to get it paid OFF within 4 weeks.  Pauline refused, said she would ONLY accept full payment today or nothing, then she hung up on me.  I called her back to get my account number and mailing address, she refused to give me that information and hung up again.  Tonight a man from NCN called my wife and said it was an urgent legal matter and he wanted my work number to contact my payroll to get "HIS" money that way....LOL..My wife refused, he got VERY rude with her so she hung up.  Please give me some advice.  I don't have an account number or I would just send post dated cheques with a letter outlining my payment offer.  I don't want to be sued and I definitely don't want my accounts frozen.

NCN distressed....oh that name Pauline brings back all the good ol' memories.  The situation you described is all most to the T of what she told me on my first call....legal matter...freeze accounts...bad credit for 20 years...pay in full...by tomorrow I want this much or I'll send someone with papers to your work (she called me at work after speaking to my husband first at home).

I started looking into the 3rd party directives for collections and sent NCN a nice letter and everything seemed to stop...months later a new collector from a different agency started calling me.  Sounds like she is back at her old tricks...and probably wasn't even spoken to about her misconduct and violation of the directives.  If i had a scanner I would post the letter I sent them....it was great!

Look up these directives and know what they can and can not be doing.  This will help you in knowing what to do next.

Good luck...don't let them push you around!

They are using heavy handed tactics to try to scare you, and the legality of which I would question.  If I were you, next time I would record the conversation and file a complaint.  From what I understand they must accept partial payments.  With respect to that a**hole that called your wife asking for your employer's payroll number, they can't garnish your salary unless they have a court judgement, and you would know if they did (you would have been served).  Moreover, the little fu&k that called can't just talk to anyone about your account.

Don't be intimated! You can reverse the power dynamic by showing them that you know your rights, and they will probably put someone else on the file.  Collection Agencies tend to replace people in charge of specific accounts in hoping to find the right person who can get you to pay as quickly as possible.  They will try always try the heavy handed approach to see if it works, but don't let it work, because you don't have to.  Pay what you can, they are just trying to b.s. you.

You might want to talk to a Johnny Leblanc, people say nothing but good things about him.  His contact info is on this website.

Good Luck!

Thank you for your feedback.    I just wrote a nice letter to NCN requesting my account number and an outline of my account, history etc(I read this on this site).  I also want to copy the "Ministry" but I don't know what "ministry" everyone is talking about.  I want to pay this off, in fact, I was paying this off....  I also requested in this letter that any further communication be done via mailings.  I also said once I received my account information I would send them a certified cheque for $500.00 to show my good faith along with post dated cheques in the amount of $250.00 monthly until this was paid off.  I am VERY concerned I may go to my bank tomorrow and assets are froze.  PS it is bad enough I live in canada and my ass ets are always freezing(Just tryint to add humor)

Distressed...LOL   PS it is bad enough I live in canada and my ass ets are always freezing(Just tryint to add humor)  No kidding!!

Try the main page of this site...it has some info. regarding filing complaints...you'll find "the ministry" stuff in there!

I am not really sure about the whole freezing your bank account thing...I've only ever heard about the bank doing EFT if your account is with the same lender your loans are through. Before you send off your money and post dated cheques...are they through the same bank your loans are??  If so, you may want to set up a different account somewhere else just for the purpose of paying the student loans.

She threatened to freeze my accounts too...but I knew my stuff was safe as I deal with a different bank than where my student loans were through.

She can not refuse immediate payment of the debt no matter what she says....

Do you do your banking from the same bank you owe for your student loans?

If your bank is different, as far as I know they can not touch your account unless they have a Court Judgment, and then they would have to go through the legal process of executing the judgement. The same goes for the garnishment of wages/salary.  I doubt they would even take you to court in the first place given that you have been making payments.

I believe that these collection agents are using these tactics because there is probably some bonus available for each account they close by a specified date, and that date is coming up.  I do not know what else could explain their intransigence, but I suspect that collection Agencies offer these incentives to employees as a means of boosting company commissions.

Please don't give in to these tactics!

OKAY, here's the latest.

I sent NCN post dated cheques, 1 each month for the rest of the year fo $150.00 per month.  I received a message today stating, "I received your message advising you sent us post-dated cheques, we are refusing them, it has already gone to the legal department."  NOW WHAT??????????????????????

John,

Thank you, I will definitely coordinate everything and call you.  But I do have a question.  Can NCN refuse these payments?  It is my understanding on various websites that the only way RBC will agree to send this to "court" is if there is a complete defiance on my part NOT to pay within 6 months of first contact.  It has only been a little over two weeks.  I cannot find a straight answer on whether NCN can refuse these payments.

Oh Yeah, One more thing, I just received a letter from NCN yesterday suggesting they will settle out the loan at $4,000.00 and they want it in their office by today.  If not, legal action would be taken.  As I said above, I had already sent them cheques and Pauline left a voice mail advising she was refusing them....blah blah blah

NCN Distressed....Pauline (my good ol' friend) is up to her tricks again!  She says the very same thing to everyone....they can not refuse immediate payment...no worries there...and if the cheques are returned to you.....let the bank know they are not taking your money.  That's not likely to happen though because then that would be refusing to accept a payment from you which is not allowed.

Seriously...give John a call...

The agency can refuse to accept post-dated cheques. If you send them a money order to be applied to the debt, and they return it, then it is against policy, most certainly.
