This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Read the report that I prepared back in 2007 here. Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their upcoming changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities can't plan. I've heard of courses being cut because the government has no process in place for universities to send the newly required acceptance letters to the government.

This means that students who have been accepted can not attend courses that start in the summer 2024 semester. With cut sections, current Canadian students will have trouble getting courses, and may have to switch to part-time which changes their enrollment status and might trigger repayment of their loans or ineligibility for funding. I've seen this before. It wreaks havoc on the student loan borrowers.

Again, the Liberal government has messed up the education environment. Will the new system needed in a rush for the acceptance letters be the new Arrivecan scandal?

I call on the government to implement a slower phased in approach and delay the requirement of the acceptance letters until a process is in place to submit these letters.

Hi All,

I wanted to post the below to help people that are in a similar situation to me. Like many here I'm in a bad situation with Student loans, it's my fault really as I was young and dumb. I'm by no means and expert, I've just read a bunch of info on this site and used as it pretained to my situation, so take everything I write with a grain of salt.

The Situation:

Finished School in December 2003 with:
OSAP - $3000
CSL - $12000

First payment due for both of these loans would have been 7/31/2004 (CSL confirmed this with me by phone)

I've never made a payment on either of these loans, the govenrment has been taking my income tax refund for years. In the last couple years I've finally obtain a decent job and because of this I have gotten larger tax refunds. My tax refunds have paid off my OSAP loan that went to CBV collections, without me making 1 payment. They have also paid down my CSL to about $10000 (only to $10,000 because the original $13,000 had increased because of interest).

So my current situation:
OSAP - $0
CSL - $10,000. (Stats Barred as of 7/21/2010)

My main concern is with my credit report, I want to repair it, ASAP. On transunion and eqiufax my date of last activity is June 2005. This is the date the OSAP and CSL loans were transfered to CBV and CRA respectively. This date is NOT the last payment date as I have never made 1 payment. Both of these items should have fallen off 7/21/2010, if rules were being followed.

So what am I doing?

I've contacted CBV Collections and CSL services and asked for evidence/letter indicating when the account originally went delinquent. CBV said it will take a few weeks but they will request the information from OSAP and send it to me.  CSL is putting it in a letter and sending it to me in 5 business days. Both of these dates will show as being 7/21/2004 as CSL has confirmed it with me already by phone.

Since it is now Sept 2010, both trans union and equifax should remove the items from my credit report as it is now passed 6 years, once I provide documentation proving last payment date. I know it's still going to be a battle.

I hope my logic and understanding of the rules is correct.

Thanks to everyone on this site, could not have gotten this far without the information shared on here!

Update: As per my telephone request,  I have recieved a custom letter from NSLSC indicating that my Canada-Ontario Student loans first became delinquent 07/31/2004 and that no payment has ever been recieved since then.

I never had any of the original documents indicating this, so it was pretty huge for me to have any type of dispute.

I sent off dispute letters off last week to both Equifax and Transunion with copies of these docs. In a perfect world my credit file should be clean up within the next 30 days.

I'll follow up with my outcome shortly!!

So the results are in from my dispute with Equifax.......DENIED. They sent a letter indicating that they have validated the dates.

I have a letter from NSLSC indicating that my loan first defaulted July 2004 and was transfered to another agency May 2005. I was told over the phone by an equifax that they do not base decisons on documents provided by consumers and that they contacted the they contact the original creditor directly.

Not sure what to do at this point.....

Am I wrong? Is May 2005 some how the date of first delinquency? I know the loan first default July 2004 and I never made a payment or aknowledged the debt. I'm confused.....

Anyone have any ideas?

Contact the student loan provider VERY CAREFULLY and question them. If you are concerned about disprupting things get professional help. The CFW Group can help you if you want.

Hi Johnny,

I did call the loan provider (NSLSC) and they provided me a letter indicating that my loans first default July 2004. I finished school December 2003 and never made a payment, so the July 2004 date makes sense. Equifax says they will not use that letter as it's was not provided by an authorized person at NSLSC.

Again they have the DOLA as May 2005, the date they transfered the loans to CBV - OSAP and Revenue Canada - CLS.

If you have experience working with CRA's and having items deleted I'm very interested in your services, if not, I'm not sure what more you can do that I haven't done on my own??

Thanks

I have access. However, subrogation dates do come into play as well.

hmmm....."subrogation date"

This is a term I'm not familar with, or have come across in all my research. I think I've pretty much outlined all the information in my above post as far as dates are concerned. So if that date is a factor then you should be able to tell based on your experience.  I'm assuming that the "subrofation date" is the date they transfered my loans away to CBV and Revenue Canada, which is June 2005? Is that date the date that CRA uses to deterime DOLA?

If you think I have a case to have these items removed from my credit report, please contact me at 6536167@**** . Let me know what you charge for something like this. I'm eager to have this stuff removed if I legitimately have a case. Please delete my contact info when you approve this post.

Thanks

SUCCESS.....

For anyone that was following this thread I just wanted to give you an update.

I continued to send Equifax dispute letters, the third letter I sent did the trick and everything has been removed from my credit file.

I have never recieved a response from Transunion, so I'm still working on that one.

My fico score was 595 2 years ago. A secured credit card and crazy high interest car loan that I never missed one payment on and I'm now sitting at 720.

I was approved for a $10,000 line of credit earlier today with CIBC.

BOOYAH!!!

If you are in a similar position, just keep working at it, it'll get better! I'm living proof.
