I went through a massive bankruptcy in 2007 and discharged in February 2008. I've been out of School since January 2000, my student loans were not included in the bankruptcy. My trustee refuses to do anything saying that only a Lawyer can apply for the discharge of my student loans which I have gathered from this forum is false information.
My hardship is that I have lost my job since getting out of bankruptcy and my current payments are less than the interest accumulation on the student debt and have been for more than a year now. My loans are both Canada and Ontario Student Loans but I've been living in Montreal Quebec for the past 10 years. In two months I will have been out of school 11 years.
Since the trustee won't do this and since I can't afford a lawyer I need to do this myself. I have called the superintendent of bankruptcy (which is an answering machine) leaving my name and number and as of today it has been 8 days without any return phone call from them. I'm calling again today.
Does anyone here know where I can go in Montreal and to get everything I need to make my own application for discharge? What forms do I need and how I can go about applying?
If anyone can help, I would really appreciate it.

Trustee is full of crapola. You can contact the bankruptcy court in the jurisdiction you filed and have them send you the do-it-yourself kit. If you get stuck on anything you can call me and I will show you how it works.

Thanks Johnny for your reply. What is the exact name for the do-it-yourself kit? Here in Quebec, if you don't ask for exactly what you want need, you just keep getting sent into an endless circle of frustration. I've described it until I'm blue in the face and I just receive this stupid look on everybody's face. I can have it within minutes if I just use the right name for the kit.

My trustee said the exact same thing and I am in Alberta. I have been trying to find out how to contact the bankruptcy court here in Alberta but have not been able to find that information.

My trustee said the same thing and I am in Saskatchewan. Furthermore, the Saskatoon lawyer who was recommended to me by the Sask Bankruptcy Court, apparently because she has a lot of experience and has an excellent success rate at these things, is impossible to reach and does not return calls or emails. It's been over a month and I have given up trying. Anyone know of a good lawyer in Regina, SK?

You can do it yourself. All you need is a guideline that illustrates what you need to provide in your affidavit. If you are experiencing hardship and can demonstrate that you cannot pay the student loan then you put together all your facts. If you want help with that The CFW Group can assist you. The bankruptcy court systems in this country all work with the bankruptcy sector. They also have relationships with the law community and they provide free advertising for their "friends". So, they may try to discourage you from doing it yourself because of this. It should be considered a conflict of interest but hey, what can you do. It is the court and legal system. They are above the law and can do whatever they want to do.
How much money do you want to spend getting help doing this?

Hi Johnny.
I'm in the same boat with my student loan. I've been discharged from my bankruptcy back in 2007 and now I'm having a nightmare with my student load. I'm in Ontario so if you can suggest who to contact I'd really appreciate any help you can provide.
