Topic: Being sued by Service Alberta Posted: 20/June/2011 at 12:01pm |
Hello all, I just got served with a civil suit on June 13, 2011. for around $6000 from an outstanding Alberta student loan. The last activity on this loan was May of 2005, I know for a fact it would be 6 years starting June 1st 2011. It was on my credit report a in May and now it is gone, which means its been 6 years. The papers were dated May 10th, but I did not get served until June 13th. Shouldn't this loan acording to Alberta Student Finacial Assistance Act, 202 Chapter S-20.5, be statue barred?
Limitation of actions 14 The Limitations Act applies to claims, within the meaning of that Act, arising under this Act except that, instead of the 2‑year period referred to in sections 2(2)(b) and 3(1)(a) of the Limitations Act, a 6‑year period applies for the purposes of this Act. I've tried to contact a couple lawyers but they won't give me the time of day. And I only have 9 more busniess days to deal with this, I'm unsure what to do. Do I have to pay this or do I have grounds to fight it? Is this something the CFW group deals with?

If you want advice how to deal with this, or discover whether or not the debt is statute barred there fees for services, yes. THe reason lawyers don't want to participate is because, for one - a lot of lawyers are advocates for creditors and their rights, and lastly - they charghe a lot of money just to talk with you.
If you want solid advice the fee is $125.00 - taxes in. This isn't an hourly fee either. That is what it will cost to help you get to where you need to be with the situation.
