Topic: EMERGENCY TIME SENSITIVE HELP!!!!!! Posted: 27/April/2016 at 1:09pm |
HELLO,
I am hoping someone can PLEASE help me!! I have old unpaid Federal/Provincial Student Loans from 2004, I am not understanding Stats Barred. I haven't paid on these loans since 2007 I avoided them for years due to finacial hardship and complications with my daughters health I just didnt have it in me to fight them. I recently went to purchase and trade in my 2005 Jeep Grand Cherroke worth less than $5k, to find out that there was a Writ of Enforcement on my vehicle.
They have since been harrasing the dealership that I was purchasing a vehicle from for a copy of my application, I phoned them to see what was going on and she said that I have to make payments on my student loan (pretty much bullied me into making a payment arragement, I never signed anything or made a payment yet) I keep seeing that unless they have something in writting or I have made a payment they can not take leagal action againts me.
Can someone please clearify if I am past the statue of limitations, the judgement was passed on me on March 2012. and if the dealership is breaching privacy by providing her with any information on my new loan, they sent them an old copy of a Canada Student Loan Agreement from 2004. These loans were in Alberta
Please I have to make a payment by May 1, 2016 or they said they will take my brand new truck, freeze my bank accounts and take the jeep I am scared and cant seem to find any help.

The collection agency may be trying to trick you into making a payment so that you lose your statute barred status.
I'd suggest you call consumer affairs. Why is there a deadline of May 1st ? Who told you that? They may just be trying to put pressure on you to give a false sense of urgency. Is the writ a legal document? Who is it issued by?
Perhaps you need some advice on this. Do they have a pro-bono law clinic?

Hello
The person I am dealing with telling me the payment has to be made by May 1, 2016 is actually from the Department of Justice Canada.
The writ is by Justice Canada as well.

If the DOJ has issued the writ then it is a legal proceeding you are facing. Just because you haven't paid since 2007 it doesn't mean that your loan is barred. Nonetheless, if there is a judgment in place as of 2012 there is certainly no limitation issue in your favor.
If you do not own the truck or vehicle then they cannot take it. Your Jeep is not worth enough for then to justify and Cost-Benefit the action. The only thing they can do is attach wages (garnish) or freeze a bank account if they know where it is that you you do banking, and an actual account #.
You need to handle this the right way to protect yourself. I can offer you that help but it is a service and not free. It is not a simple project, and advice is not going to fix it for you. There are several things you can do but you you are the one who owes this money. Therefore, they are going to do and say thin gs that will force you to do things that may even be financially damaging to you. They don;t care about you. They just want the money, and it is a government with a lot of power, and "human" reason to do so, which means there is also financial benefit (and incentive) for government agents.
Best of luck!

If there is a limitation issue then you would be undermining your own case if you do so. This is what they do - trick people into admissions by enticement or the usual collection pressure tactic. Enticement comes when you resist or work towards overcoming them to loosen their grasp on you and the situation.
This is what CFWG Inc and Solve Student Debt helps people like you you with. It is specialized, cost-effective, and accessible anywhere in the world where you may be, US or Canadian. you can go tot he site and schedule an assessment or you can call 866-239-7889 tomorrow and schedule one. Pretty simple.
