Topic: old student loan Posted: 10/August/2018 at 3:09pm |
I currently have an old student loan about 30years old. When I received my student loan I had found out at that time that I had aboriginal status and notified the student loans office in Manitoba. They took my registration number and other personnel info. I didn't hear back from them for about 10 years, We went over the status information once more and again didn't hear back from them for about 5 years. There has been a back and forth with student loans as aboriginals are to receive an education supported by the government. I recently got a call threatening action so I asked for a copy of the original documentation for proof of debt. They refuse to supply it and are now threatening legal action. I am permanently disabled from a work related injury and am on wcb. I have no means to pay this back. Nor do I have any information about the loan as they refuse to supply any information other than the occasional monthly statement. Any help would be greatly appreciated. Thanks for your time Dennis

Just to update. I called the number on the letter that threatened legal action. I did not admit to anything although they tried to get me to on numerous attempts. They inform me that they were going to take legal action no matter what. They also informed me that they would not supply me with any information on how the dollar figure was obtained. So I called student loans to see if they could enlighten me on the letter and they informed me that they have no information on me. They said I should call CRA legal. Not sure if that is a good move as I am not proficient in legalize. thanks Dennis

If they actually told you to call CRA Legal Services then, usually that is who has carriage of the account. If this is the case then it's something to be quite delicate with. If it is assigned to CRALS then the only reason would be litigation. That is what they do.

It was the Student loans fellow that I talked to, he suggested calling the legal team because he didn't know what else I could do. Should I call them or is this potentially beyond any sort action on my part? Is this something that your company could help with?
Thanks Dennis

I would like to know how the dollar amount came to be. What loans are they talking about. Canada Student Loans claims I am not on the books and they have no information on me. The collections area are refusing to supply me with any information on the debt and stating that they are going to taking legal action. How am I to defend myself and or try and come to some sort of resolution if I am not allowed access to the information. Thanks for your reply Johnny Dennis

Johnny In fact how this got to where it is. Several years ago I had asked Student loans to clarify the statements that they were sending. They told me that they couldn't. So I thought to myself, if you are unable to provide any information on a debt that you are trying to collect, that possibly there is no debt at all. So I stopped the payments. They still to this day will not provide any information. Dennis

If you want me or someone here to jump in and communicate with them to provide data and transparency concerning what they are saying you owe that can be done. However, once we get that for you, is that all you want?
Let's say we get you this information, then what? They are going to want to know what you intend to do about the loan. What sort of resolution are you looking for, and is that what you are asking for help in achieving as well?

Hi Johnny I am. That is exactly what I would like to do. 1. determine what the debt is. Proof of debt and a detailed accounting of it.
2. If there is truly a debt, then I would then like to address it in an amical and agreeable fashion.
I don't know what your credentials are or how your company works, but it appears from your responses that you are well versed in handling these types of situations. Of course there will be a cost involved. How do I get in contact with you?
Thanks Dennis
