 Hello everyone. The package is being sent in the mail that I need to fill out and return to get help with my debt. I am on a permanent disability. I was on disibility when I applied for student loans but my situation is getting worse. I am also in default as I have been unable to repay my debt. Are my chances of getting help low because:

1. I was on disability already when I applied for student loans?

2. My loans are now in default as I have been unable to pay?

Any insight will be greatly appreciated.

from what i have been told in my quest ( which is fast turning into a homer-esq oddyssey) even though you are in default they will still look at your package and "you MAY qualify" for debt reduction/medical loan forgiveness/disability repayment benefit.  how was it worded in my last letter - oh yes.  "be assured that any submission will receive every consideration".  i am in default as well.  miracle of miracles, the bank is giving me time to get my ducks in a row and is not turning me lose to the collection agency yet.

you have the 'upper hand' over me as your disability was preexisting and already noted on your file.  consequently, it should be easier for you to qualify for the 'permanent disability benefit', as long as you have already exhausted your interest relief etc.

i have the lovely task of convincing them i really am unable to sustain any type of job.  and did i mention that the meds i am currently trying are making me worse ??  or that i spent two years undiagnosed ??

keep me posted, i can always use some company on this roller coaster ride.  here's hoping we both get a happy ending.

My rollercoaster ride basically boiled down to:

If you are on provincial disability you are already have proof of your disability in the federal government's eyes. If you have disabled insurance, a disabled placard for your car or get fuel tax refund you have proof

The PITA is that you have to jump through someone else's hoops before the Federal Government will even look at you. (*Insert grumpy words here*)

You STILL have to then get a doctor who supports you to help you battle with the government.

..Interest relief for the disabled doesn't expire. I was on interest relief for five years. All it required was every 3 mo's (now 6, I hear) I filled out the income thingy and fax it to them. (And faithfully at least once a year CIBC didn't recieve my paperwork, took money out of my account till I closed it and forced me to throw Scottish temper tantrums until they gave me my money back.

Hang in there with the Canadian medical system - it SUCKS.

i am assuming you have no drivers license as you are considered legally blind ?  that will also help i should think

I haven't had a driver's lisence since, oh, the mid 90's or so.

I was diagnosed with bipolar and schizoprenia two years ago. I was going
through the disability process and decided to try and get my degree first
and try to have a normal life rather than being hounded by psyche
doctors who like throwing you in the hospitol. A mistake to try to go back
to school. Because I became a student again my application for disability
was sent back. I couldn't complete my degree because my illness got
worse at school. Now I'm out a place to live. I have consumer debt from
living off credit. I have to get settled somewhere..Bankrupcy seems like it
doesn't even work..life is scary....I want to apply for student debt
forgiveness...which means back to the doctor's office..but I don't know
about if I can of not because I've not expired all my interest releif..I may
have on some loans from many years ago. I was last in school fall
semester of 2004.......

even if you've exhausted your IR and been initially denied DRR you still have options.  try applying for disability again.  see your doc. (this is what i am doing).  if you get approved for disability you can then apply for a disability benefit in repayment ( i think thats what they call it, i am exhausted and can't think straight) which would essentially get the student loan monkey off your back.

don't give up.  i swear they design the system to frustrate us so we give up.  keep trying, even if you do get denied you can always appeal.  see my posts in the disability claims help forum and check out the template for loan forgiveness mark has posted there.

Thank you for replying..This battle feels pretty lonely.so,,the process of
getting on disability would be to apply first for welfare and then for
disability. Doctors are ready to sign anything that says I'm too crazy too
work or go to school (these guys can be worse than loan sharks-but I
guess they are doing it for the good of my health)...I'm happier to be
pretending I'm just like everyone else But, health problems like mine are
very controlling...However, the process for disability is a very long time I'd
imagine.Once I am receiving disability payments do you have the
numbers I can call to ask for disability and hardship forms? I know I can
easily have a doctor sign what is needed so I can show that I have a
permanent disability..Do I have to be living off of disability at the time of
sending in disability hardship claims to student loan? I have no income at
the moment..no place to live....and the chance of me being able to get a
job are very slim...Even if I happen to be having a bright day and luck out
with a job...They will eventually fire me once noticing signs of my illness..
trying to find a place to live is just as hard...

Regarding your Disibility Claim , If you are in Ontario get legal aid to help you if they turn you down, dont give up, Take it all the way to the Social Benefits Tribunal again with legal aid. My doctor had told me that if i did it myself(representing my self i would get now where) But if you involve legal aid youll have a better chance. ODSP(ontario disibilty support) turned me down right till one week before the Tribunal. With legal aids help I won my case. Down side when you appeal itll take a year and a half before reaching tribunal stage. then about another 4 to 5 months if you win your case. But just keep appealing etc.

There are special Social Assistance lawyers called "Community Legal Clinics."

For example, here in Kingston, ON we have the Kingsotn Community Legal Clinic.

All they do are SARB (Social Assistance Review Board) hearings. They are the experts.

Their services are free.
