Hi I live in newfoundland but in 1994 I had a student loan from nova scotia, any way I am not not working and have never worked since I recieved my loan. My husband and I are on social assitences. I have been having calls for over four years now looking for payment on my loan. like I very nicely tell them I can't pay for I have no money and I am living below the poverity line as it is. So every six months I fill out the all the forms and still they will not leave me alone. They try to take my GST checks and I have to fight to get them back.Is there anyway I can get rid of the collection people and still keep my GST for I really depend on it. Hope someone can help me out there.

I am common-law so this may be different for you... not sure.  I am in Ontario.

But this is how it worked for me... I filed my income tax individually and because I did not make enough money I was eligible for GST.

I get my taxes done at H&R.... my spouse than takes my income and claims me as a dependant... and gets the full amount of my GST added to his.  (It is called transferring or something..ask about it..or maybe someone else knows???)

Any income tax deducted from my earnings (which of course, normally I would receive back) are then seized by the government to pay my outstanding federal loan.

This year who knows... I have made over the dependant amount ... and have not filed yet.  Though I will be there as soon as T-4's are issued....

Momk...I would be loosing my GST cheques too--but one way around it is to let your husband claim this part in his income taxes....that is how we are saving ours since they take my income taxes all ready.

You could always phone the government body responsible for issuing your GST and explain you are on social assistance/financial hardship and they may be able to help you with not fighting to get them back as maybe they may be able to stop your GST from being taken. They may ask for proof of income.....or advise you on what you can do....

You will have to send HRDC all documentation that you have little or no means to pay your student loans.

I remember working at a minimum wage job and practically starving, and they would not take the lien off for me.

Given that you are on social assistance, talk to your social worker and maybe something can be done for you.

hi thanks for the  good help but I have one more question.If my husband did not sign for my student loan and he has no income either can they go after him.It has been 11 years since i had my loan and was not able to pay on it. i am only getting about 8000 a year and my loan is only 2200 there must be a way to get this thing straighten out with out losing my little GST money.I have no faith in the welfare system down here.

Boy am I ever glad that I found this site for it has given me alot of help. one more question.If i don't have any income coming in and my husband did not sign any papers on my loan and I have been filling out financial questionnaires for the past four years do I have to keep filling them out for they know by now that we are on social assistance or the next time they call I can tell them to go take a flying leap.Would I not be able to apply for stats barred for this account has been going on for over 11 years with no money going to them.I also plan on claming the GST in my husbands name and not mine anymore.THANKS EVERYONE OUT THERE FOR ALL YOUR HELP. GOOD THINGS WILL COME TO ALL OFF YOU.

No one can go after your husband or anyone else for your student loan debt.
Personally, I did not even know my bf, when I took out the loans, but awhile back when they found out where he works they actually called him at his job and threatened to sue him.
They exchanged some choice words and that was the end of that.

And don't let the collectors intimidate you into borrowing money from friends, family.
One collection agency wanted me to take out a loan to pay off my balance and their interest rate was 29.9%.
Geez, they must have thought that I was stupid, like the collector.

i still think asking the collector to cosign a loan for you is the way to go .  think about it - they get their commision for the whole amount and since its a personal loan and not a student loan they can just default and claim bankruptcy on it - no  waiting period .  sure they have no credit for six years but hey that commission check would sure be great and they'd look like heros closing so many files ...

sorry, mom is in a mood this morning.  i missed all the hoopla last night and i'm feeling bummed.

Hi up  date. Called NCO today and told them that I wanted my account put in stats barr, well that just about freaked them out.She got very mad and told me that I did not know what I was talking about and that I could not go that way for I have been filling out financial questionnaires and this meens that my account is still active. So i told her that from now on they will be no contacted from me. That really pissed her off and she told me she wanted my account paid in full. Like I told her have fun getting the money for I have no money to give and that I would be contacting my lawer. So she finally told me to call her back on thursday and she was going to have my account dismissed. So we will see what happens and in the mean time I will not be filling any papers out and any long distance calls coming in will not be answered

Hunter! How did you manage your account has been transferred back to the creditor?

I was successful last year when the bank took my account back from CA. That time they admitted that it was done by error. Now my account with another CA. This time situation worth: a) there is no evidence in writing form the bank; b) I am not working. However, I would like and I think I can pay $40-50 monthly to the Bank.

I guess I figured out now that I have two loans.
The Canada student loan is what I am paying on to HRDC. Whereas the Saskatchewan portion of it where I owe $ 38,000 they would not accept my $50 payments.
Hope this clarifies things for you.

This questionairre things really pisses me off.... they tell you to fill it out to access what you can or cannot pay.... it may keep them from hounding you.... but when it has kept you from being stats barred that is simply the system screwing around with you....

it is like saying yep... we know that you are on social assistance and have not worked in 10 yrs.... but lets just fill it out again... and keep this debt hovering over you forever.

 The submission of a financial questionaire is a mandate set out by HRDC and Provincial governments. If it is a bank-risk or shared loan, then a financial questionaire is something the collector can ask for - but you are not mandated by any law to do so. Only for Federal or Provincial debt. 

 A financial questionaire entry will result in an acknowledgment, most certainly. 

 As for the statutes of limitations ... if you are unable to pay, then the way to go about this is to appeal the matter based on financial hardship. If you are proven to be in financial hardship and will be unable to pay the debt in the future, then simply substantiate it. People who attempt to ride out the statutes in the hopes of becoming debt free... usually find out that it doesn't work that way. The debt is simply not legally collectable at this stage. it doesn't mean that the debt is not owed, and it certainly doesn't mean that it will be removed from a credit history permanantly.

 The problem is that the government has created  problems not only for people - but themselves as well. They invented the bankruptcy business. They also invented Canada Student Loans. They lost hundreds of millions of dollars worth of Canada student loans to bankruptcy between 1994-1997. They realized how retarded this was - so they simply immunized themselves from the bankruptcy syndrome - as they see it.

 That is the problem with our government. They keep coming up with all of these solutions to problems , but in the long-term, these so-called solutions escalate into much larger problems.

 How much longer will it take for the government to put the Ki-bosh on the statutes of limitations persuant to the CSLP? If they feel that a large number of people are abusing that, just like bankruptcy back in the days, then I am sure they will pool together in a large assembly, and start ammending the statutes in the same fashion as they did persuant to the BIA.

I am wondering if we may have confused "financial questionaires," in the case of "Momk."  Collection agencies ask for financial questionaires but in order for Revenue Canada to remove a lien or set back on your income taxes you also have to prove hardship by sending them all kinds of information which isn't really a financial questionaire.  Not in my case, anyways. 

Revenue Canada put a set back on my 2003 income taxes and, my being stubborn, I decided not to file them.  I called the NCS and asked to have the set back removed because we were experiencing hardship.  They had me 1. fax them a letter explaining my hardship, 2. send proof of income (in our case it was proof of no income which meant I had to get a letter signed by someone who knew me for at least 10 years testifying that I had no income) and 3. my expenses (rent, grocery expenses, insurance, etc...)  The first time I sent all the documentation they said we didn't qualify but never gave us a reason.  I was still very stubborn and decided I still wasn't going to file those taxes.  I sent letters to the Prime Minister and to many ministers (thanks to this website, I found all the correect addresses) and explained my situation.  Because I hadn't file at all this meant I received no child tax benefits, no GST and of course no refund.  But I persisted and persistence does pay off. 

When I received a response from Cogliati instead of minister Volpe, I wrote to Volpe again.  This time I receive a response and a a phone call from NCS asking me to send all the neccessary information once again.  I did and miraculously, we qualified - the set back on our taxes has been removed.  Our measly little income did prove we were experiencing hardship and so we are going to be receiving our 2003 refund, GST's and CTB. 

Now, I don't know, but I am presuming that social assistance in Newfoundland is below the poverty lines and therefore should pose no problem as to proving hardship.  But take it from me, you must be persistent, they will try to say that there are people who are in worse financial circumstances than you, but don't give up.  When you are living (or as I say "surviving,") on low income those GST checks are often a lifesaver, and an income tax refund really helps for those nasty emergencies (in my case a broken down washing machine.)

Hi miss3. well twice i have gone toNCS to have my GST cheque given back to me and I had to prove to them that I was in hardship. I had to send them a light bill that was overdue, which was no problem when you live below the poverty line.With all the questionnaires that i filled out and filled my income tax they should be able to see that there was no money. oh I forgot these people don't know how to read they are just puppets on a string.Well I will be damed if they are getting my little bit of money. If they want a fight well a fight they will get

I know exactly what you mean Momk.  It's true that they should know, and we all know that they know, but my theory is that they give us a hard time in the hopes that we'll give up.  And many do indeed give up and some of us don't know and so they do manage to force a payment out of someone's low income. 

They were going to take my refund - just over $1000 - peanuts to them, but it meant a great deal to us.  We have no health care plans to which most people tell me "but you live in Canada - you have health plans."  What good is free medical check ups, emergency visits, etc... if you can't pay for the treatment (ie. medecine,)?  My mom is a diabetic, she's on a disability pension and her insulin is covered, but not the needle.  At one point an unforeseen emergency left her with no money to buy her needles so she went without for a few days.  I suggested she go to the hospital (the M.P., the M.P.P., the papers, anywhere) with her insulin and ask them how she's supposed to get the insulin into her body.  But mom isn't one to make noise.  (Sorry for the little rant, just had to get it off my chest.)

I'm glad to hear that you will keep up the fight.  If enough people make noise maybe we'll get heard.

We all need to say how we feel.. about all these wonderful little policies.... insulin... but no needles.. that is unbelieveable... miss3.

Reminds me of my mom talking about her trillium plan... it is based on last years income.. not current years... so if you made more last year you pay a higher percentage for this years drugs... does not consider that this year when the money crunch is on... you might need a little relief on the drugs... again this is bizarre.  Yes it all ends up working out in the long run... but not when you really need it.

Hi an up date:    Just got off the phone with nco where they were looking into getting my dept forgivenYea right. Well i have been filling in those dam questionnaires everytime they sent one for the last four years and it proves that i have no money but guys this is where they get you.IT HAS TO BE EVERY SIX MONTHS  ON THE NOSE NOT SEVEN OR EIGHT SIX AND ONLY SIX.So what they do is send out the forms just when the six months is up and now when you sent it in it is passed the cut off time{dammed assholes} Sorry my turn to be in a mood. I was still very nice on the phone when i was talking to her.So now she tells me fill out an other questionnaire and send in all the prove plus this time write a letter telling why I want my loan forgiven.Well Duh I have not been able to pay it in 10 years  and i am living below the poverty line but that does not matter just as long as i pay them off.my god some people can be so stupid{that's the government for you}Well baby they want a letter they are going to get a letter.

Momk, I deal with NCO as well!  What a treat, eh !  Funny, they don't send me any financial forms--yet, then again, they are collecting on my bank risk portion.  It's hard to remain polite sometimes!  They definitely know how to get under one's skin .  I tell ya....I had some good practice with Nordon before my file was passed onto NCO.

When I was dealing with Total Credit Recovery for the crown portion of my CSL, one of the beauties was right braindead.  I explained that I had sent the financial form in with all the proof they wanted and she still asked questions that were easily answered with the info. on the forms....so I asked her...Did you review the forms I sent you?  Everything is on them!  She says, those things don't matter anyway.  I thought to myself...then why the He** am I wasting my time with this!  It doesn't matter to them, but it does matter to the HRDC.  And even better--I called and asked if they had received my financial form and another air head says...oh, they must not have received it...some peoples' payments were lost this month.  I was like ....some peoples' payments were lost this month--is she kidding me??  The lies that these people tell are enormous.  So i looked through my paperwork and found a letter stating they had been in receipt of my FIF....I phoned her back in about 10 minutes and quoted to her the letter and her brilliant words were...hmmmm...they must not have updated the notes.  You think???    I felt pretty good that day...catching her in one of her lies!!!!  I just wish I had that being taped.....but, that was before I knew any better.

Momk, good for you for not letting them suck the life out of you. I hope you do get the loan forgiven. If your collection agent says that they forgave the loan, make sure that is true by contacting HRDC. Don't take collections word for ANYTHING.

The fact that you are on assistance clearly proves financial hardship, so, as they say in Nfld (I'm from there too): No matter how hard you try, you can't squeeze blood out of a turnip.

Hi the first thing this little lady is going to do is to write a letter to HRDC asking for my depts to be forgiven and then I am going to send a letter to NCO imforming them that I have asked for my loan to be forgiven. I am not leaving it up to the NCO to do it for me like they want to for if I am right they will come back and tell me that HRDC rejected my application for dept relief and there for I will  still have to pay. So I will be handling all of my letters and I will let HRDC just how bad my situation is. I will included my husbands income{assistance payments} and they will be told his health problems{chron's}.I will given them so much information and sad story that they will want to pay me.{wishful thinking, but we can dream}So they will have no choice in releiving me of my dept. one question:do I have to tell them that I have a credit card.Not alot of credit limited but it helps from month to month to feed a family of four.

Hi forgot to ask a question: if you apply for  loan forgiveness and you have a disabillity do you have to send them letters fron the doctor to prove that you are incapeable of working.What makes me the maddest the people that I owe the loan to are the people give me the money every month, so ya think that they would get thier head out of thier ass do their jobs right.Man if i could only have them by their b...s I would make them squirm for awhile just like they do to all of use.Sorry Momk is in a mood and they are the reason for the more you sit and think about what they do to people the more pissed... off you get.Must go get some fresh air for have had enough of this sh*t. yes you have to submit medical reports etc to document your claim.  and if they dont' think you are disabled enough they will reject your claim.

I was wondering that i recently got a house due to paying more for rent that what a mortage would cost. I could not do this myself my mother co-signed for me and she has good credit. I am a single mom of 2 children ans is working, but of couse only relying on one income it is very difficult. I have my federal student loan that went into collection on nov.2, 2001. I heard that once 6 years are up this is written off.  I also live in Newfoundland.They have asked for settlement of 4000.00 on the whole loan of 8000.00. Since december of 2004 i have been making steady payments of 25.00/month. They called me the other day and stated that i would either pay in full or go for the settlement, i could pay 25.00 for 6 months but they stated that they would not offer the settlement again and that once the 6 months is up that i would have to pay the loan in full, or they will garnish my wages, put a judgement and a lean on me or even possible sue.
I am afraid that they will take my house are they able to do this? Should i pay the payments or will it be written off in this comming november when it has been in collection for 6 years.

I have few questions? If anybody is interested in answering them.
 
I have been paying for my student loans for the past 9 years. I have been giving a minumum payment of 40 to 50 dollars month. They have come down a bit. I have been dealing with NCO financial Service.
 I have had times were I've had to argue with them, demanding payment in full. Just recently i had a girl from there calling me and harrassing me. I told her i would send in more chequues, but all of sudden i recieved a threatening letter delivered to my work of employment. Demanding me in full payment. Solicitor something it stated. So i ended up calling NCO and talking Management. I didn't approve of girls tactics she was using on me. I told him that i would work with him, but not that girl. So my questions is?
 
He sent me a budget form to fill out and should i fill out this budget form out and give them all that info or will they use it all against me?
 
Or should I continue to send my cheques and shut them up for while again?
 
The other thing i have found is that when i go to deal credit checks, these loans are not on there.

I have a student loan that was sent back to the federal depart in 2005 and during the year 2006 one collection agency ARO claimed that i need to pay them 2500 for the intrest on the student which was $1300, which i settled the payment for $150/month after 2 months they ask another guy, which asked me to pay off right a way, harass me on the phone non-stop, forced me to borrow money from wells fargo with intrests rate 32%, each month i need to pay $100 for that loan, since that they didnt call me, i thought nightmare is over, In march 2007, another collection company COLLECTCOM CREIT called me again said that my student loan is due, and forced me the last $175 from my salary each month to pay them back, after i pay for 2 months, they asked for auto transfer from the back, then i ask them to sent me a copy of the statement which i am paying the right account or place, make sure this is not a scam, but they refuse to, and threaten me that they will take 33% of my pay cheque every time, ever since then they keep calling my work place to harass me. Today my manager picks up the phone and the collection agency talked in a rude tone and harass my manager too, thanks to that phone call, i now unemployed, i wonder what i can do. Please can anyone help me? And can they really allow to take money from my pay cheque?

Hang in there, sounds like a rough day.
 
It is my understanding that the collectors can not take money from your pay cheque without a court order.   Thus the the collector was lying to you, trying to freak you out.
 
I think you should file a complaint against the collection agency with the provincial regulating agency.   The collector has been harassing you.
 
The collector should not get away with this.  Harassing your boss resulting the loss of your job is just wrong.   
 
I would call Johnny, at CFW group, I am sure he would have some advice.
 
Is there any chance your boss may let you keep your job?

Try to talk to your boss.. show them the studentloanfairness.ca website... ask for some understanding.

Document all the things that happened and then go talk to a legal aid office. You may have grounds for suing the collection agency for harassment.

This is regarding all of the people who have student loans that the gov't are forcing peoples wages to come out of their paycheques, I personally dont think that they can do that because people need that money to survive on, I myself am on social assistance so I know where you are alll coming from. I have a two year old son that I raise by myself and if the gov't were to do that I wouldnt have barely little to feed my son with , I owe about 40,000.00 and the interest keeps on growing on that. I think that when people sign for a loan I think that there should be more information given to clients before they gets into signing a loan. Because I have found over 6 years that when I go to get a loan or credit card that it comes back and says that they regret that they cant process the application form. As far as I am concerned student loans damages peoples credits for life. And to have these collection agencies calling and harrasing is not good enough and probably telling mothers or fathers or etc when ar e they going to work also damages someones self-esteem .I think that  tuition should be free. Or the collection agencies should be willing to help out their clients to get them back on track with their credit instead of making them feel bad about the loan that they took out...

It is not only the lack of information, it is the location and language of this information. Most find the system confusing than helpful. Others say that the information provided does not matter because even if they follow it - they still end up in an unfortunate situation due to systemic incompetancies.

i got a student loan in NB in september 2001 and since i quit before the year was over; i was told the loan became payable on the day i received it. now i never made a payment on it nor have i aknowledge it as i was always working minimum wage jobs or not working at all. it's been over 6 years now but they still have a lien on my income tax return but not my gst. i did file my taxes 2 years ago and the lien on my taxes got all the money i was getting from my income tax return. does that count as a payment and restart the 6 year statute of limitations? i just want to be able to fill my taxes so i can get healthcare and see a doctor. this lien on my taxes is killing me slowly! i am in no shape to pay it.. can someone please help with any information. thanks!

the second they locate you, they get 6 more years to get you to pay.......that is their legal right

you might be better off to take the hit......depends how much you owe and how much you want to clear your name

i am confused krazybear......did you not state you had a lien on your taxes re student loans?  if so, is that not based on having acknowledged the debt or are you saying after they re-locate you after 6 years of no contat, you must acknowledge the debt once again if they locate the debtor?  haven't had a chance to go back to the legislation to check this out, but i will when i have a moment........

it seems to me that if one acknowledges the debt once, that's all that is needed....though as i said, i haven't checked the law on it

Limitations are based on the acknowledgment factor, and the prescribed period of time whereas the loan provider has to recover the money owed. Simply locating a debtor does not constitute as an acknowledgment. Acknowledgment is very clear in the CSLFA. I have cited it in many posts. You can use the search engine onthe site.

yeah well, johnny, that doesn't answer my question.......for a lien to be placed on krazybear's taxes, it seems to me there had already been an acknowledgement............ in any case, they ARE collecting student loan money from krazybear, from what i can make out, so the point is moot as they could not do that without first having had an acknowledgement

since there has been some activity and continues to be collection activity, (seizing her of his taxes)  is it not false to say they have not been able to collect in the last 6 years? .......

i wasn't confused about the ackknowledgement issue per se, i am wondering if once they have not located you (and you have or have not acknowledged the debt during the first 6 years)  does everything start over, i.e., do they need a new acknowledgement to pursue you for the 2nd 6 year timeframe?

I just recently requested my credit report and received it. Nothing happened. No one contacted me. The student loans were not even on the Equifax report.
 
My understanding of the lien aspect is that they are done by the provincial loan. There is no SOL in Ontario so the lien stays in perpetuity until the provincial loan is paid. Not sure if there is a SOL on the provincial loan in your province.
 
I'm not sure why you need to file income taxes to get health care? My response to the lien was to stop filing taxes and I still have health care. There is no legal obligation to file income taxes if you don't owe any tax. Your access to health care is a function of being a resident of your province.

I'd check into that... not sure if thats correct. Also you might want to file to get your GST rebate... and have it on file that you didnt earn anything as opposed to the CRA thinking that you did but didnt file!

The government does not need an acknowledgment to gaff tax rebates. If you read into the legislation it clearly states that the govenrment, at any time, can seize money owed to a borrower in default at any any time. In layman's the act says - "you may not have to pay us money you owe us after a certain period of time. However, we do not have to pay you monies we would normally owe you in right of her majesty the queen". There are some loans that are statute barred that still have the lien ancored - and there are some that do not. Each case is unique.

I didn't know that but I double checked and there doesn't seem to be an alternative route for income verification so it does look like you need to file your taxes or pay the premiums.
 
Your fear is that if they confiscate your tax refund that payment will constitute acknowledgement?
 
I'm having trouble understanding the reason you are reluctant to file your income tax.

I'm positive. Tax law was one of my specialities. I'd only have to file a return if I owed tax or was requested to do so by CRA.
 
I would get GST Rebates and about $1200 in Ontario Rental Credits if I filed but that would all be seized anyway so there is no reason to bother filing.

it's not like we went off subject..they are both directly related..but anyways.. i'm just scared that doing my taxes will constitute as "payment" towards my loan and will keep it on my credit report for another 6 years.. i'm trying to get my credit score back at 0. i know it seems very complicated to myself also. maybe getting a credit report would clarify some things.

When the government seizes you income tax, it is not a voluntary action on your part. Therefore, it cannot be construed as an acknowledgment (admission of liability). They do not want you to know this, mind you. Arming yourself with information is a good safeguard.

i don't understand something..........if the government can seize your taxes, its because it can prove they are owed to them........isn't it?  also, when you sign up to receive your loan and deposit them, you sign a whack of papers that outlines the loan.......that should be enough, in my view, to acknowledge you owe monies and the conditions under which you agree to........it may not show the "entire" balance of multiple transactions, and this may be what y'all mean by "acknowledging the debt", but on a contract, amounts, conditions and signatures are there........i can't see what difference it really makes, except for the "total" which may/may not be in dispute

you admit you are liable, when you sign the contract and if you paid it, you can usually prove it - if there is a misunderstanding of payment - no?  its a contract and likely they are collecting the tax refunds on that basis, no?

i would beg to differ that a loan agreement has nothing to do with a statute of limitation or that the government can seize money owed to the crown, with no proof of it -  i was saying it appears the proof needed to seize that money (to prove the debt to the crown), is the signed loan agreement (aka student loan contract)

From experience here on the site, just cause the law says something doesnt mean its followed. Taxes have beens seized without apparent documentation, the govt still trys to collect stats barred loans (see the OSAP grant recovery section), and even if the loan is paid to the collection agency, the taxs will still be seized, and tax seizures arent reported to the student loan people for months. And collection laws are ignored cause nobody polices them.

But on another point, I need to raise the issue that we're getting into a situation here on the board where its turning into a legal discussion rather than replies that help the original poster. The load on the website is now very heavy, so please keep replies on focus and to a minimum... and focused on the original question... and need for help.

A loan agreement is proof that money is owed. That is all. The government knows who owes them money. THey don;t need to cite a loan agreement to gaff tax rebates. THey just do it.

Stats barred doesn't make the loan noncollectable. Stats barred is an absolute defence to any court action but the onus is on the borrower to raise the defence.

Every other person has to go to court to garnish monies from you, why can the crown take your tax refund without going to court, this is not EQUAL treatment.  The crown should be treated EQUALLY with everone else.
 
What do the folks with a legal background, eg Bateman and Ottawa Gal think?   Are there Charter issues here?

If the loan is Ontario (OSAP), they claim that all loans carry no limitations. Therefore, they anchor liens for the life of the debt. If you can prove that the loan is barred, then they would have to remove the lien unless legislation states otherwise. We all have the right to fairness and justice - so says the charter or rights. However, I would guess that the policy of student loan recovery is not a violation of a right, except when such an action occurs whereas the borrower was placed in tht situation as a result of an error or wrong-doing by the lender and/or it's third-party service provider.

Your understanding of s.15 is just wrong. If you want me to explain why it is wrong I can but that is a long tangent and you can just trust me on it.
 
s.15 though would possibly be useful if it could be shown that one particular group was harmed by a particular aspect of student loan legislation. The SCC has entertained arguments about group rights and, even though I personally am vehemently against group rights, there is some case law involving social assistance legislation.
 
The problem is that with student loans I don't believe any one of the enumerated classes is overrepresented. There might be a slightly larger number of females but not by the significance required. Johnny would know better but just by using this site as my sample it doesn't seem like 90% of people who are having hardship over student loans are female,  of a specific ethnicity, of a specific religion etc.
 
With respect to s.7 the Charter does not deal with property rights so it does not apply. But even if the Charter did address property rights I'm pretty sure the liens would be saved by an application of the Oaks test.

this is not legal advice.....it is my personal opinion......based on 7 years of legal studies.........i don't see how you'd have a snowball's chance in .......well, u know!

S.7 is much much broader than that. For example it has been used to strike down anti-private medical insurance legislation. It is also the reason abortion is legal etc S.7 is probably the most versatile quasi-right guaranteed by the Charter.
 
There is some interesting case law involving s.7 and psychological integrity. Basically that security of the person applies not only to the physical body but also to mental. There might be an argument that some of the collection tactics allowed would be considered a  psychological threat. I don't know enough about this to comment. If someone was interested in pursuing this it has a much higher chance of success than anything mentioned in the class action discussion.

I have an old loan from RBC which i could pay back,  then I began going to school again and have been a full time student since 2003.  I have 1 semester to go and I need the student loan for that semester but Allied Consultants has somehow gotten my new student loans frozen until I'm back in good standing with the old RBC loan. 
 
The thing is I tried to get back in good standing with RBC but they required that i pay the interest before i could go on interest free status. I was a student, I had no money to pay anyone anything.  RBC suggested that I write a letter asking them to capitalize the interest.  I did so and they then demanded the entire loan to be repaid.  I stopped dealing with them and they refered my case to Allied.  But now Allied is influencing my ability to finish my degree.  What do I do?  I'm a full time student and have no money to pay anyone anything and am almost done.  In 6 months I will be able to pay the entire old loan off with one paycheck.  This is rediculous.

Hi,
I am seeking some answers about CSL, BcSL,  and the giant interest rates they are charging. I made a regrettable decision in 2004 to take out a student loan for a 1 year business management course at a local crook oops!I  mean community college.  I was young  and made a bad decision. I graduated the course with good grades considering the condensed courses considering its a 2 year program at the local government college/ university. basically I believe I was goated into taking out a huge and unrealistic student loan for the wage expected after graduation also at the time interest was a very unknown topic for me. I had an issue with the college and the BCSL and CSL, the college told me my repayment start date was later then it actually was so i was screwed before I even started I missed my payments without even knowing they were do. With no interest in making minimum wage i decided to go back to the job i knew would help pay the bills the best ..Roofing . Anyways i had my loan default so i was no longer able to seek any help through the student loans program. So i went back to living every day life trying to make ends meet with a baby to support i stopped thinking about my loan. i recently got in touch with both BCSL and CSL to arrange payments possible to find my loan gained $3000 in interest for BCSL and another $3000 for CSl. I think this is really a criminal thing here how the heck is anyone supposed to pay back that loan and bring down the principle when the interest is so high I should have went to be a doctor to be able to pay my monthly payments.  I have not payed them any money and was reading some posts about bankruptcy and getting to a point where they will stop charging interest. any replies with any information would be greatly appreciated and I would also like to say that I'm very pleased that this site is here to help people deal with the almost criminal practices of the governments and colleges and universities who are obviously scratching each others backs and screwing good people out of there future or giving them a future at the price of their future. thank you

since nobody here was able to help me i've done a lot of research and talked to the experts. the information i aquired will not please anyone but atleast you know what will happen.... first off, there is NO statute of limitations on student loans... trust me i tried!! secondly bankruptcy will only work if you haven't been studying for 10 years and 1 month...(they are trying to change that to 7 years..) so ... if you don't pay it; it will follow you into the grave!! they put a lean on my taxes so i've stopped filing my taxes. there is a program where you can arrange to pay it off in one large sum... if you pay off like half the debt in 1 payment, they can agree to that! which is the best thing i found!

I wish we had been more helpful... just to note that there is no official program to reduce the amount if you pay a lump sum, but some lenders will accept a lump sum... I know that OSAP rarely does that and rarely do do the feds. If its with the banks there might be a greater possibility of that happening..

Make sure that if you do one of these settlements that you get it in writing before you send them the money.

Someone has given you incorrect info... the DDR program is only available if you have exhausted all interest relief, and your loans are not in default.

It does not involve making a lump sum payment.
If you qualify for DDR, the government will reduce your loans...but few people ever qualify...

I have a Student Loan debt from 1996 and a small EI overpayment debt (~$2k)..  Canada Revenue has garnished my wages @30% without making any contact (in regards to the EI debt).  Is this legit?  Do they need a judgement, etc for other than Income Tax debt?

The EI overpayment was $2400... they've since garnished close to $1k (3 pay periods).  The CSL amount is ~$12k.

$35k.. single.  Spoke with the guy yesterday re the garnishment on the EI debt..  says he sent me a form to list my expenses/income..  to determine if 30% is really too much.  He mentioned that after the EI debt is dealt with he would deal with the CSL.. I suggested that it's been 12 years, and mentioned statute limits.. he said no such thing.. they can collect anytime.

Yeah.. that's what I thought.  He advised me to contact a lawyer re any statutes, etc..

When in default of student loans,  can they take property,  homes,  vehicles etc?  I know that if I declare bankruptcy,  the first 20000 in my home is exempt and my vehicle if owned outright.  The reason I am asking is that I am contemplating bankruptcy,  I just can't see any other way.

It is not possessions tht you should be concerned with. It is whether or not you will be percieved as someone who can contribute towards your student loan. If they do perceive you as someone who can pay, you will be forced to repay. It is that simple. The government(s) will oppose your discharge. This is something that people need to think about when entering or contemplating insolvency proceedings.
 
If you cannot pay them - demonstrate that to them. If you are not bankrupt then you can't go bankrupt (unless a trustee wants to be creative and make it appear that you are bankrupt).

CBCL   was handling my OSL part of my osap but they aren't handling it any more.  i was in alberta for the last six months.  got back -Ontario- not long ago.   no one has called or mailed me anything. so WHO HAS MY LOAN(OSL) ?    Can't understand why they haven't written me yet.

I do  have good news though i have a good job now so i look forward to paying this crap off- if i can find out who the hell has it.
 
 
to all those who are still fighting-  stay strong.  i hope to see you on the other side-that's the side were we finally pay off are loans and tell the agencies to kiss are...
