If a credit check is being done on  you, for reasons of employment....Do you have to authorize it, by checking off that its ok on the application, of can they run a check without you consenting?

i believe you have to consent to it, otherwise you can file a complaint with the privacy commissioner of canada and the offending party can be charged.  dont quote me though.

I would like to know if NCO can look into my credit report without my permission.

Thanks

If NCO has been assigned a debt to collect from you, then they can acess your credit history. Your creditor allows them to do it.

If there is a section requiring you to ok the request, then I assume that they do need your consent. Contact the privacy commission to find out.

Just curious, what type of job requires a credit check anyway? Seems like an odd request to me, but perhaps this is standard in some fields of employment??

There is no statutory obligation to allow an employer to investigate your credit. It's none of their business and if they don't hire you, because you refused, you may have a case. There are exceptions however, and this may relate to circumstances for example, if you wish to work for Brinks or the police servfce or perhaps a bank. There is good caselaw in this area.

Dear Johnny,

Please do not assume that they can access your credit bureau. The collection agency acts as an agent for the creditor, being a bank or the loan program. Collection agencies receive an upload of thousands of files and they run a program to pull a credit bureau on each file. The collector is then assigned the file and they have a copy of your bureau, possibly without even knowing that you did or did not consent in writing to allow any credit bureau member to pull a credit bureau on you.

As a consumer, in Ontario, for ex., you must consent in writing.

It is a fact. Agencies are alowed to access your credit fuile - and they do. This is one of their tools they use. If a colection agency is hired, they can run reports and they do not need your permission, unfortunately. They do run manual reports all of the time. There are rules that they have to follow, such as not running a report excessively.

Collection agencies act for their clients. Unfortunately, their clients give them a little too much freedom in many cases though.

Does pulling a credit file negatively affect a person's credit rating the same as doing a credit check?  If so, it seems very wrong that a collection agency can pull your file without your permission.

They do not need your permission (they already have it). The permission is given by the loan provider. The contract states they they are able to rquest this information, and so is any third-party they hire with respect to recovery.

Call Backcheck and see what they have to say.
