I had an Ontario student loan and a Canada student loan.  I also had credit card debts.  I have been living overseas for 10 years and have not been contacted re these loans or credit cards for that time.  I am thinking of returning to Canada to work for a year.  Before I do that I want to make sure that my loans and credit card debt are no longer existing (they were not paid in full).  How can I check this?

Who would I need to contact re the 2 loans and do I need to contact the bank for information re the credit card debt?

In doing so, am I admitting that a loan may still be outstanding and therefore restart the statute of limitations period?

If I open a bank account for my pay to be deposited can they take my pay to repay outstanding credit card debt?

Also, can you suggest a secure site for getting my credit report?

I very much regret ever taking loans and signing up for credit cards on campus where they made it so easy however I have no one to blame but myself.

Any assistance you can offer would be greatly appreciated.

Thank you

Why weren't you making payments on your debt?

The Ontario portion of your loan will always be there - it has no limit.  In the period of time that you have been out of country, it has likely doubled in size.  The Canada portion MIGHT be statute barred.

Of course,  there may also be judgements against you for both parts of your loans and perhaps your credit cards.

I suggest you start the process by checking your credit.  You can get a credit report from Transunion for free, by registering with creditkarma.ca.  You can get a free Equifax report from ratehub.ca

You should not contact anyone.  Doing so may reset any statute of limitations by acknowledging the debt.

Thank you for your response.

I was paying all debt while overseas by sending money back to my mother.  Once that option was no longer available I was told by two banks in Canada that I had to return to the country to may my debts. That was not going to happen, therefore payments were no longer made.

Can you advise how I can apply for a credit report as it seems each of the websites I have tried (including those you mentioned below) requires a Canadian address which I do not have.  Also, by applying for a credit report can you confirm that will not restart the statute of limitations?

Also, would the statute of limitations not apply tot he credit debt as well?  You mentioned below that there may be judgments against me - what sort of judgments?

Thank you once again for your help.

Enter the address you last used on any credit application.

Whenever you apply for credit your address is updated with the address you applied with.  Often also, when you update your home address with your creditor, they will also update your address on your credit report.

So, think back.  Where were you last living IN CANADA when you either applied for credit or updated your address with your creditor?  Use that address.

Judgements can be applied against you, in you absence, if your creditor can show that they have done everything possible to find you.   Judgements are in many cases visible on your credit report.

Forgot to mention, the goal when requesting your credit report, is to prove your identity.  You do this with your SIN, and by matching your address with what they have on file.  They will also ask you a few question about your credit report to prove your identity.

So, you want to use the address that they have on file.  Don't use your current address.
