Not sure where to take to my fight now, looking at a dead end, and hoping someone can point me in the right direction.  I'm pretty sure I can establish that my Ontario Student Loan got sent into default owing to someone else's error, but I don't know where to take all the documentation (to the CIBC or to OSAP?) or what I can expect (or even hope for) as a solution -- can I get it recalled, or at least correct my record with the credit reporting agencies?  Here's the story...

I had two loans being administered by the CIBC, a CSL and an OSL.  Both fell into arrears back at the end of April.  I work in forestry and was out working in remote locations from May until late August, when I got into Thunder Bay, checked my e-mail and discovered what a sh*tstorm my SLs had landed in while I was out earning the $ to keep paying for them.  My mother had written to tell me that there was a pile of mail and a stack of phone messages.

So on August 30th, I got in contact with what I thought was a CIBC rep at the number I had been given (turns out this was in fact a CA, at Global Credit & Collections, though I was unaware of this at the time).  I was presented with the option of paying the outstanding interest and applying for a revision of terms -- I asked quite specifically if this would bring everything back into good standing and was assured that it would.  Payment to both accounts was made in cash on August 31st at a CIBC branch, I contacted the CA again and was told that the application for a revision of terms was being filed.  Again, I was assured that everything would be brought back up to date.

Well, with the CSL, that was true.  Revision of terms accepted, and as of today everything is tickety-boo.

The OSL was claimed on September 1st.

Now, I also have loans at the NSLSC (one CSL and a Canada/Ontario Integrated) that also fell into arrears over the summer.  On September 3rd, I was able to make arrangements to pay the interest on those and have received approval for revision of terms on both.  Those are both presently in good standing.

So, that's where I stand.  Now can anyone help me figure out what I need to be asking for, and who should I address this too?

Apologies for the verbal diarrhea, and thanks in advance for any and all assistance.

Call CIBC NSC. Ask for a recall investigation on you OSL. What kind of proof do you have that there was an error? Gather everything that you have before you call, tell them that you have additional info and that you want to fax it in. (a recipt for the payment that you made at cibc would be perfect, you said you paid there in cash. If you dont have that recpit call the bank you made the payment at for it). If you did make the payment that day, and your loan defaulted the next, I think your chance is good.

Quick update...

I do have copies of receipts proving payment was made on the 31st ... additionally I've now gotten in touch with the branch where I made the payment (where I was lucky to be helped by a kind and concerned staffer who even waived a $25 service fee for me) to look into their files as well.  They have faxed me copies of their receipts.  Additionally the woman at the branch reminded me something I'd forgot about that day -- that when payment was made I had them fax proof to the CA, and their notes indicate that this was done.

So I'm writing the letter to request a recall investigation this afternoon.  I'll post a draft here later for remarks.  Does anybody know to whom at the CIBC it should be addressed, or just to their Student Loan Centre?

Never through anything away. Always keep a copy of anything. NEVER  send the originals. Keep everything.

Recall is a long lengthy process. If you are approved, to transfer your file will take 4-6 weeks. Upon arrival you will be asked for any outstanding interest. If not paid, then it will be returned back to the collection agency, and you last chance for hope of recalling gone with it. It will then be your error, and it won't come back.
