Hello, I am being called by ARO about what I believe are federal student loans from about 15 years ago and do not know if they are stats barred. I realize the time frame is sufficient but I did discuss it on the phone about a year ago and even tried to setup payment through their generic email address (which was completely ignored, may not have received it??). So basically I believe I may or may not have reset the clock.

Do I have a legal right to demand to see my file from them or do I have some other sort of recourse to determine the status of these loans (and if they are federal)?

Yeah, it not something you can simply assume.  You have the right to access your personal information, and what they store about you, yes. You can file a request through the bank's privacy office, or request a statement of account even. Just avoid doing anything in writing at this stage if you want to protect yourself.

If you want a limitation analysis and discovery done so you are absolutely sure what the status is then we can do that for you if you want. What you should be most concerned about is the number of loans you have out there. In my experience most students that come to CFWG aren't sure who and what they actually have out there. So, we end up "scrubbing" the entire system for student loans outstanding so they have the facts. Then we go from there.

If you want a quote it really depends on the work involved, and financial benefit. We do very accommodating flat rates and-or a small percentage of the financial benefit to you.  The financial and relief benefit to you is huge.  Our fees aren't. :)

Thanks Johnny,

I definitely will be in touch to figure out if there are more floating around. I am just confused about your first paragraph. You mention avoiding anything in writing - do you mean with the collections company or the bank's privacy office too? Wouldn't the request through the bank be in written form?

Anything you send in writing will have some effect (likely a very bad one) on a limitation issue. The only advice I am allowed to give you because you are not a client is to be aware of these dangers. If you issue an access request then there is a good chance it could cause disruption. So, look for ways to gather your stuff without writing to anyone. You can call them all day long and although they say "AHA! You've acknowledged your debt", you really didn't in the legal sense and definition of what constitutes acknowledgment.

If you are a client of mine or whomever here then it is not an issue you need to concern yourself with. We are able to do these things without agitating or disrupting anything. This is one of the most used and cost-effective services we provide.

Limitation issues are not something anyone should be playing around with on their own, unless you exactly what you are doing without question.
